Terms of Service — pilot draft for review

1. Who provides Darpan
Darpan is operated by VG, an individual, for the private, invite-only pilot (“we”, “us”). The operator's full legal name and postal address will be published before public launch; for now, contact the operator at [email protected]. These terms cover our hosted account service, website and authorised use of the Darpan remote-desktop service. Our Privacy Policy explains how information is handled; agreeing to these terms does not waive your privacy rights or replace any consent required by law.
When these terms become effective, use of the service is subject to them and any separate written pilot agreement with you. If you do not accept them, do not use the service. Anyone accepting for an organisation must have authority to do so.
2. Private pilot, eligibility and charges
Darpan currently operates a private, invite-only pilot. There is no public sign-up and no payment collection. An invitation is permission to participate in the pilot, not a promise of permanent access or a future paid plan. Paid services would require separate pricing, payment, cancellation and refund information before purchase.
Account holders must be 18 or older; minors may not hold accounts. Household members under 18 may use a host only under an adult account holder's responsibility, subject to applicable law and any required parental consent. Do not invite someone to create an account who does not meet these requirements. The account and invitation flows do not verify age, and parental-consent tooling does not exist yet. A household invitation alone does not verify age or parental consent.
3. Accounts and control of your hosts
Use an email address you control, protect your passwords and sign-in links, and keep your devices secure. Cloudflare Access email verification and the Darpan account login are separate security steps. Do not share credentials or pairing codes. Tell us promptly if you suspect unauthorised access.
Pair only machines you own or have permission to administer. You control who you invite to a host and which local user account and role they receive. Give access only with the machine owner's and affected users' permission. Remote access can expose the entire desktop and permit actions with that local account's privileges, including changing or deleting files.
Check host settings before enabling clipboard sharing, file transfers, audio, microphone access, recording, administrator viewing or agent access. Explain enabled features to affected people and obtain any permissions required by law. Keep independent copies of important host files; ending a session or deleting a cloud account does not erase local files.
4. Acceptable use
Use Darpan lawfully and within your authority. Do not use it to:
- Access another person's device or account without permission, steal credentials, bypass access controls, or test systems without authorisation.
- Deploy malware, disrupt networks, send spam, impersonate others, or facilitate fraud, illegal gambling or other unlawful activity.
- Harass or exploit people, harm children, or transmit unlawful sexual content, non-consensual intimate images or deceptive impersonations, including unlawful synthetic media.
- Infringe intellectual-property rights, confidentiality or privacy, or use information belonging to someone else without permission.
- Evade service restrictions or interfere with the security or availability of Darpan or its providers.
You retain your rights in your files and content. We claim no ownership of them. You authorise the technical processing needed to provide the remote-access features you use. This is not permission for unrelated advertising or sale of your content. You remain responsible for software and services you run on a host, and for other people's information you access through it.
5. Software and third-party services
Darpan's own software is proprietary. The repository licence does not itself grant permission to use, copy, modify or distribute it. No general host-client licence or EULA is supplied by these terms. Ask VG at [email protected] for separate written pilot permission specifying the permitted use before using the host client; do not assume an invitation supplies that permission. Licence scope and delivery must be settled before public distribution. These service terms do not silently grant a broader software licence.
Third-party components retain their own licences and notices. Your rights under those licences are not restricted by these terms. Hosting, network and email providers support the service as described in the Privacy Policy; independently used third-party software and services have their own terms.
6. Availability and responsibility for loss
The pilot is experimental and may change, be interrupted or end. It has no uptime commitment, service-level agreement or guaranteed support response time. Network conditions, host configuration and provider availability affect connections. Do not rely on it for emergency services or situations where an interruption could cause injury or serious loss.
To the extent permitted by law, the pilot is provided as available, without a promise that it will be uninterrupted, error-free or suitable for every purpose. We are not responsible for losses caused solely by systems outside our control or your unauthorised use. To the extent permitted by law, we exclude liability for indirect losses that were not reasonably foreseeable.
Nothing in these terms excludes liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, or any consumer, privacy or other right or remedy that cannot lawfully be excluded. Mandatory law takes priority over these terms.
7. Suspension, termination and deletion
You can stop using Darpan at any time. The account settings provide account deletion with email and password confirmation. Deletion can stop if provider cleanup fails; check the result and contact us if it does. Host unpairing, membership removal and cloud-account deletion do not delete the host's local user accounts, files, recordings or downloaded copies. We may suspend or end access to address misuse, a security threat, a legal requirement or the end of the pilot. Urgent security or legal action may be immediate. Where practicable and lawful, we will explain the reason and allow you to contact us about mistakes. Unlawful conduct can also carry penalties under applicable law and may require reporting to authorities. Do not assume that suspension deletes your data or that cloud-account deletion removes a separately configured Cloudflare Access permission.
8. Changes and disputes
We will publish revised terms with their effective date and communicate material changes to pilot users by email or an in-service notice before they take effect, unless an urgent legal or security reason requires earlier action. Changes do not retroactively remove accrued rights. Where law requires renewed agreement, we will request it. You may stop using the service if you do not accept a change.
These terms are governed by the laws of India, with disputes subject to the competent courts at Delhi. This choice does not remove mandatory protections or any right to use a competent consumer forum, regulator or other authority under applicable law.
9. Support, privacy and complaints
Support, privacy requests and abuse reports: [email protected]. Grievance officer: VG, Grievance Officer, at [email protected]. A postal complaint address will be published before public launch; use email during the pilot.
For a complaint, describe the affected account or host, what happened and the action you seek. Do not send passwords, pairing tokens or unnecessary sensitive files. We may ask for proportionate information to verify your authority.
